Personal data means any information relating to an identified or identifiable natural person (‘the data subject’); a natural person is regarded as identifiable, which can be identified directly or indirectly, in particular by association with an identifier such as a name, an identification number, location data, an online identifier or one or more special features, the expression of the physical, physiological, genetic, psychological, economic, cultural or social identity of this natural person (Article 4 (1) GDPR).

2. Data collection, processing and usage

a.) Purpose of data collection and scope

We collect personal information in order to:

    • to accept and process your orders,
    • to send you our newsletter and
    • If necessary, to answer questions from you.

We collect the following data from you:

    • Name and first name,
    • Age (since we only deliver to adults),
    • Address
    • Ordered goods
    • Delivered goods
    • Specify which form of payment you are using
  • E-mail-address

Not from us, but from the respective payment provider (for example credit card companies) information about your means of payment is stored. We only receive information about whether the payment was made by you.

In addition, to protect our systems, every time we access our website and retrieve a file, we store access data in the form of log files that consist of the following information:

    • The website from which you visit our site
    • Your used IP address,
    • The access date and time,
    • The information about the browser you are using and your operating system.

b.) data processing

To provide our website, we use the WooCommerce service, developed by Bubblestorm Management (Pty) Ltd (WooCommerce.com), Unit A206, The Old Biscuit Mill (TOBM), 373-375 Albert Road, Woodstock, Cape Town, South Africa and operated (hereafter “WooCommerce”). WooCommerce provides us with its online e-commerce platform through which we can offer you our goods for sale. Your inventory and usage data will be stored on WooCommerce’s servers. Based on your device data, we will create a device ID that will allow your access device (eg PC, tablet or laptop) to be recognized on another visit to our website. We also set a cookie for this purpose (see also below under “Cookies”). The cookie contains the device ID, but no personal usage or transaction data from you. This will allow your access device to be recognized without identifying you by name and associating it with your device ID

3. Transfer to third parties

We only pass on your personal data to third parties (subcontractors) to the extent required, who are commissioned by us to process an order (payment and delivery, if applicable, redemption) and who are only permitted to use this data for a specific purpose. Incidentally, your personal data will not be transmitted to any third party. We use your data only for the purpose for which they were given to us.

4. Cookies and Clear GIFs and their use

a.) Cookies

Cookies are small files that make it possible to store specific device-related information on users’ access devices (PCs, smartphones, etc.). They serve for the user-friendliness of web pages and thus the users (for example storage of login data). On the other hand, they serve to collect statistical data on the use of the website and to be able to analyze it in order to improve the offer. b.) Clear GIFs

Clear GIFs (also known as “web beacons”) are used in conjunction with cookies to give website operators a better understanding of visitors’ interaction with the website. A Clear GIF is basically a transparent graphic that is placed on a web page. Using a Clear GIF allows us to measure the actions of the user who opens the page with the Clear GIF. Anonymously, we measure visitor behavior using Clear GIFs to improve visitor experience and facilitate content management. We use Clear GIFs u. U. on this website, in our e-mails or in our advertisements on other websites or in e-mails from third parties. We do not create any usage profiles of you.

5. Our Newsletter

With our newsletters, we inform you about us and our offers. If you would like to receive the newsletter, we need a valid email address from you. This will only be used to send the newsletter and will not be shared with third parties. The registration for the newsletter takes place in the so-called double-opt-in procedure, which means that when you sign up for the newsletter, you will initially receive a non-promotional confirmation e-mail, which you must confirm by clicking on the link contained in the e-mail. Only then do we start to send you newsletters from time to time. You can revoke your consent to the sending of the newsletter at any time. The revocation can be made via a link in the newsletter itself, in your profile area (if you have created a user account) or by notification to the contact options listed under point 1.

6. Google Analytics

We use Google Analytics, a web analytics service of Google LLC (“Google”), based on our legitimate interests (that is, interest in the analysis, optimization and economic operation of our online offer within the meaning of Art. 6 (1) lit. GDPR Google uses cookies. The information generated by the cookie about the use of the online offer by the users are usually transmitted to a Google server in the USA and stored there.

Google is certified under the Privacy Shield Agreement, providing a guarantee to comply with European privacy legislation (https://www.privacyshield.gov/participant?id=a2zt000000001L5AAI&status=Active).

Google will use this information on our behalf to evaluate the use of our online offer by users, to compile reports on the activities within this online offering and to provide us with further services related to the use of this online offer and the internet usage. In this case, pseudonymous user profiles of the processed data can be created.

We only use Google Analytics with activated IP anonymization. This means that the IP address of the users is shortened by Google within member states of the European Union or in other contracting states of the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be sent to a Google server in the US and shortened there.

The IP address submitted by the user’s browser will not be merged with other data provided by Google. Users can prevent the storage of cookies by setting their browser software accordingly; Users may also prevent the collection by Google of the data generated by the cookie and related to their use of the online offer as well as the processing of this data by Google by downloading and installing the browser plug-in available under the following link: http://tools.google.com/dlpage/gaoptout?hl=de.

7. Google Tag Manager

Google Tag Manager is a solution that allows us to manage so-called web site tags through one interface (including integrating Google Analytics and other Google marketing services into our online offering). The tag manager itself (which implements the tags) does not process users’ personal data. With regard to the processing of users’ personal data, reference is made to the following information about the Google services. 8. Google-Re/Marketing-Services

On the basis of our legitimate interests (ie interest in the analysis, optimization and economic operation of our online offer within the meaning of Art. 6 (1) lit. DSGVO), we use the marketing and remarketing services (“Google Marketing Services “), LLC, 1600 Amphitheater Parkway, Mountain View, CA 94043, USA, (” Google “).

Google Marketing Services allows us to better target advertisements for and on our website so that we only present ads to users that potentially match their interests. For these purposes, when Google and our other websites access Google Marketing Services, Google immediately codes Google and becomes so-called (re) marketing tags (invisible graphics or code, also known as Web Beacons “) incorporated into the website. The IP address of the users is also recorded, whereby in the context of Google Analytics we announce that the IP address is shortened within member states of the European Union or other parties to the Agreement on the European Economic Area and only in exceptional cases to one Google server in the United States transferred and shortened there. The IP address will not be merged with data of the user within other offers from Google. The above information may also be linked by Google with such information from other sources. If the user subsequently visits other websites, they may be shown according to his interests, the ads tailored to him.

The data of the users are pseudonym processed in the context of the Google marketing services. That Google stores and processes e.g. not the name or e-mail address of the users, but processes the relevant data cookie-related within pseudonymous user profiles. That from the perspective of Google, the ads are not managed and displayed to a specifically identified person, but to the cookie owner, regardless of who that cookie owner is. This does not apply if a user has explicitly allowed Google to process the data without this pseudonymization. The information collected about users through Google Marketing Services is transmitted to Google and stored on Google’s servers in the United States.

Among the Google marketing services we use is u.a. the online advertising program “Google Ads”. In the case of Google Ads, each advertiser receives a different “conversion cookie”. Cookies can not be tracked through the websites of advertisers. The information gathered through the cookie is used to generate conversion statistics for Ads advertisers who have opted for conversion tracking. Advertisers will see the total number of users who clicked on their ad and were redirected to a conversion tracking tag page. However, they do not receive any information that personally identifies users.

We can incorporate third-party ads based on the Google AdSense marketing service. AdSense uses cookies that enable Google and its affiliate websites to serve ads based on users’ visits to this site or other sites on the Internet.
In addition, we may use the “Google Tag Manager” to integrate and manage the Google Analytics and Marketing Services on our website.

9. Social Plugins

a.) Social Plugins

Our website uses social plugins (“plugins”) from the Facebook social network operated by Facebook Inc., 1601 S. California Ave, Palo Alto, CA 94304, USA (“Facebook”). The plugins are marked with a Facebook logo or the addition “Social Plug-in of Facebook” or “Facebook Social Plugin”. When you visit a page of our website that contains such a plugin, your browser connects directly to the Facebook servers. The content of the plugin is transmitted by Facebook directly to your browser and integrated into the page. Through this integration, Facebook receives the information that your browser has accessed the corresponding page of our website, even if you do not have a Facebook profile or are currently not logged in to Facebook. This information (including your IP address) will be sent from your browser directly to a Facebook server in the US and stored there.

If you do not want Facebook to directly associate the data collected via our website with your Facebook profile, you must log out of Facebook before visiting our website. b.) Facebook Remarketing

We use Facebook’s remarketing feature “Custom Audiences” on our websites. Through this feature, we can target our visitors to advertisements by showing personalized, interest-based Facebook ads to visitors to the site when they visit the Facebook social network. To perform the feature, Facebook will implement our remarketing tag on our website.

Through this tag, a direct link to the Facebook servers is made when visiting the website. This will be transmitted to the Facebook server, which of our websites you have visited. Facebook maps this information to your personal Facebook user account.
